Resolutions to add the following territories to the Consolidated Maintenance District and approving, confirming, and adopting the Public Works Director’s Report for each:

 

  1. Area 4-217 (3345 & 3403 Bernard Street) – Ward 3
  2. Area 4-218 (721 Brundage Lane) – Ward 1
STAFF RECOMMENDATION:

Staff recommends adoption of the resolutions.
BACKGROUND:

On June 10, 2020 the City Council adopted Resolutions of Intention No. 2051 and 2052 respectively, to add the above territories to the Consolidated Maintenance District as required by Section 13.04.021 of the Municipal Code. Inclusion in the Consolidated Maintenance District will provide for the maintenance of parks and/or street landscaping. For an area where a park has been constructed and/or street landscaping has already been installed, the area will be under the park and streetscape zones of benefit and will be assigned appropriate tier levels during the next Annual Update to the consolidated maintenance district. For an area where a park and/or street landscaping has not been installed, the area will be assigned appropriate tier levels when improvements are constructed.

The addition of these territories to the Consolidated Maintenance District is not prohibited by Proposition 218.

The City of Bakersfield has received a letter from the owner(s) of the properties described above which waives the public hearing concerning inclusion in the Consolidated Maintenance District.  This allows the City to expedite the maintenance district process to satisfy the subdivision requirement.  The owner(s) also have submitted a Proposition 218 ballot indicating their consent to the assessments.

In order to provide future property owners with disclosure regarding the inclusion of land in the Consolidated Maintenance District and the estimated maximum annual cost per equivalent dwelling unit, a covenant has been drafted and will be recorded for each territory with the Kern County Assessor-Recorder’s Office upon approval of these Resolutions.
